OLSS Obtains Summary Judgment Compelling Immigration Service to Reevaluate Arbitrary and Capricious Denial of Visa Application

On October 13, 2017, a Federal Court in New Jersey directed the U.S. Citizenship and Immigration Services to reevaluate its ruling in denying even a part of a visa petition made by Soccer Centers, Inc. for 10 soccer coaches.

The Court (Hon. Esther Salas) found that the government’s denial of the applicant’s alternative request seeking some, but not all, of the visas was arbitrary and capricious because the agency did not set forth an explanation for its decision.
