Xiao Sun handles a broad range of complex commercial disputes in both state and federal courts, as well as sophisticated trust and estate litigations in New Jersey and New York.

Xiao has significant experience representing businesses, business owners, shareholders, and executives in all areas of commercial litigation, including cases involving contracts, business torts, shareholder disputes, and other issues arising from commercial activity.  He has counseled clients through all phases of the litigation process, including discovery, motion practice, trial, appeals, as well as complex post-judgment litigation to collect against judgment debtors shielding assets.  Xiao prides himself on being able to counsel clients “soup to nuts” in all aspects of commercial disputes. 

Xiao is also a skilled trust and estate litigator, representing estate, executors, fiduciaries, and beneficiaries in a wide variety of disputes before probate courts. 

Before joining OLSS Xiao was a judicial law clerk for the Honorable Michael Hubner, J.S.C.

  • Representation of business owner against company’s chief financial officer for breach of fiduciary duty and embezzlement
  • Secured multi-million-dollar judgment on behalf of partner of real estate joint partnership, including 1.5x punitive damages, including second-chairing weeks-long trial
  • Obtained significant sanctions against judgment debtor for violations of charging order against judgment debtor’s interest in limited liability companies
  • Successful litigation on behalf of sole beneficiary of estate to remove executor for breach of fiduciary duty
  • Defense of estate and executors in post-death continuation of matrimonial litigation and dispute as to validity of will and codicils
  • Defense of trustee of irrevocable life insurance trust against allegations of breach of fiduciary duty
  • Defense of medical device manufacturer and salespersons against multinational corporate plaintiff claiming breach of restrictive covenant
  • Successful appeal on behalf of non-profit health care provider resulting in vacating of million-dollar judgment
  • Defense of class-action lawsuit alleging false labeling of consumer food products, false advertising and fraud
  • Successful defense of class action Telephone Consumer Protection Act litigation
  • Successful litigation on behalf of co-trustee to prevent decanting of substantial trust
  • Appointment as guardian ad litem for Chinese-speaking client in guardianship litigation
  • Numerous appointments as court-appointed attorney for alleged incapacitated individuals in guardianship litigations
