Our Litigation and Dispute Resolution Group is comprised of experienced trial and appellate advocates with versatile practices in both state and federal courts, as well as in mediation, arbitration, and other forms of alternative dispute resolution. Many of us have worked together throughout our careers. Our department is a uniquely cohesive team of moderate size that has reaped the full benefit of its senior leaders’ wealth of trial and appellate experience. Our clients never interact with our B team – because we do not have one.

  • Successfully defended federal and multi-state product liability, consumer fraud, and Telephone Consumer Protection Act (“TCPA”) class actions by defeating applications for class certification and obtaining dismissals through summary judgment.
  • Represented a leading New York real estate developer and investor in defeating a $10+ million third-party claim by a major property owner in a commercial foreclosure action arising out of a $5 billion commercial mortgage-backed securities (CMBS) transaction.
  • Obtained a judgment of $5+ million (including $3.5 million in punitive damages) in a family real estate joint venture breach of fiduciary duty case.
  • Represented investment fund in securities and accounting malpractice actions arising from Madoff scheme, obtaining judgment of $14+ million against “feeder fund” manager and first known judgment (of $2.25+ million) against major audit firm for failing to detect Madoff fraud.
  • Secured New Jersey Supreme Court’s unanimous reversal of erroneous construction of Check Cashers Regulatory Act, allowing client's long-established business to remain open.
  • Successfully defended the owner of a regional New Jersey airport against a decade-long municipal condemnation action.
  • Successfully defended the chairman of a major South American business conglomerate in a weeklong civil contempt trial in New York state court.
  • Obtained summary judgment dismissing a federal Lanham Act claim for trade dress infringement seeking damages exceeding $100 million.
  • Recovered a $13 million compensatory damage award arising out of failed joint venture agreement.
  • Successfully defended fraud and civil racketeering claims and achieved a $2.6 million settlement on a counterclaim for breach of contract involving the disputed capital contribution obligations of limited liability members.
  • Recovered a $2 million breach of contract judgment for a national telemarketing firm against one of the country's largest financial services companies.
  • Represented an attorney before the New Jersey Supreme Court in a case which invalidated financial disincentives in law firm agreements restraining the practice of withdrawing attorneys.
  • Advocated for a Johnson & Johnson heir in extensive fiduciary litigation.
  • Represented one of New Jersey's largest law firms in its successful defense of a multi-million-dollar attorney malpractice claim.
  • Won a jury trial in a federal court dispute between boxing promoters involving former heavyweight champion Lennox Lewis.
  • Represented attorneys before the New Jersey Supreme Court in a case that clarified the proximate causation standard applicable to attorney malpractice actions.
  • Pursued oppressed minority shareholder claims concerning a family-owned, closely held landscaping and snow removal business to a favorable, multi-million-dollar settlement.
  • Argued before the New Jersey Supreme Court the enforceability of stipulated damages provisions in multi-million-dollar bank loan agreements, resulting in the establishment of a new legal standard for the enforcement of such provisions.
  • Represented an international bank before the New Jersey Supreme Court in a case advocating the recognition of the claim of creditor fraud against third parties.
  • Successfully defended against a claim for breach of a multi-million-dollar real estate sales contract, obtaining summary judgment.
  • Defended a New Jersey-based nutraceutical company against state and federal regulatory proceedings.
  • Successfully defended a New Jersey-based, multi-family housing developer in a five-week, federal court bench trial against $5 million tort claims.
